2. Eligibility

You must be at least 18 years old or have the consent of a parent or guardian to use our services. By placing an order, you warrant that you meet this eligibility requirement.

3. Orders and Payments

  • Order Acceptance: All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraudulent activity.

  • Order Placement: All orders must be placed at least 72 hours in advance to ensure availability and quality. Custom cake orders need to be placed at least 3 weeks before the pickup/delivery date for the best quality.

  • Order Confirmation: Orders are only confirmed once full payment is received. We reserve the right to decline any order at our discretion. We also reserve the right to confirm orders with partial or no payment.

  • Pricing: All prices are listed in Australian Dollars (AUD) and include Goods and Services Tax (GST) unless stated otherwise. Prices are subject to change without prior notice. Once payment is made, the agreed price will not change.

  • Payment Methods: Payment can be made via bank transfer, online payment link, or other specified methods, including Visa, MasterCard, and PayPal. Full payment is required at the time of placing an order or at the time of pickup if agreed.

4. Product Information

We strive to display accurate product descriptions and images. However, actual products may vary slightly in appearance due to baking processes or ingredient availability.

5. Cancellations, Modifications, Refunds, and Returns

  • Cancellations: Orders may be cancelled up to 7 days before the scheduled delivery or pick-up time. Cancellations made after this period will not be refunded. Once an order is confirmed, no further changes are permitted, including changes to flavours, design, or quantity. For all orders, we reserve the right to decline cancellation/refund requests or provide partial refunds.

  • No Refunds: We do not offer refunds once an order is confirmed, except in accordance with the Australian Consumer Law for major product failures.

  • No Returns: Due to the perishable nature of our products, all sales are final. We cannot accept returns or exchanges.

  • Quality Concerns: If you believe there is a significant issue with the quality of your order, please contact us immediately within 24 hours of receipt. We will assess the concern and, at our discretion, determine if a partial credit for future purchases may be offered. No cash refunds will be provided.

6. Collection and Delivery

  • Delivery Areas and Times: Delivery is available within certain areas during specific hours. Delivery times are estimates and not guaranteed. Please inquire about delivery charges before placing the order.

  • Collection: Orders must be collected at the agreed time. Harvi’s BakeHouse will not be responsible for any changes in product quality due to late collection.

  • Risk of Loss: Risk and title pass to you upon delivery or pick-up of the products. Harvi’s BakeHouse is not liable for any damages caused by delivery delays.

7. Allergens and Dietary Requirements

  • Our products are made in a kitchen that handles nuts, dairy, gluten, eggs, and other allergens. Although we take care to avoid cross-contamination, we cannot guarantee that our products are completely allergen-free.

  • It is the customer’s responsibility to declare any allergies beforehand and review the ingredient list when placing an order. Harvi’s BakeHouse will not be liable for any adverse reactions caused by allergens.

8. Design and Product Variations

  • While we strive to match designs as closely as possible to customer requests, all our products are handcrafted and may vary in appearance. Colours, shapes, and decorations may have slight differences from reference images.

  • Customers agree to allow creative discretion in the final product, acknowledging that minor variations are part of the handmade nature of our items.

9. Limitation of Liability

To the fullest extent permitted by law, Harvi’s BakeHouse excludes all liability for any indirect, incidental, or consequential damages arising out of or in connection with your use of our services or products. Our liability, if any, is limited to the value of the product purchased.
